Acceptance of Terms

By accessing and using the services provided by Xyvorant AS ("Company", "we", "our", or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. These terms apply to all visitors, users, and others who access or use our culinary guide services.

Service Description

Xyvorant provides local cuisine guide services in Stavanger, Norway, including but not limited to traditional market tours, restaurant experiences, and cultural food storytelling. Our services are designed to showcase authentic Norwegian culinary heritage through guided experiences with local experts.

Booking and Payment Terms

When you book our services, you agree to the following terms:

• All bookings must be made at least 48 hours in advance
• Payment is required at the time of booking or as otherwise specified
• Prices are quoted in Euros and include applicable VAT
• We reserve the right to modify prices with reasonable notice
• Group sizes are limited as specified for each experience
• Special dietary requirements must be communicated at booking

Cancellation and Refund Policy

Our cancellation policy is as follows:

• Free cancellation up to 24 hours before the scheduled experience
• Cancellations within 24 hours may incur a 50% charge
• No-shows will be charged the full amount
• Weather-related cancellations will be rescheduled or fully refunded
• We reserve the right to cancel experiences due to insufficient bookings
• Refunds will be processed within 5-10 business days

User Obligations

As a participant in our services, you agree to:

• Provide accurate information when booking
• Arrive punctually for scheduled experiences
• Behave respectfully towards guides, vendors, and other participants
• Follow safety instructions and guidelines provided by our guides
• Inform us of any allergies or dietary restrictions
• Not engage in behaviour that may disrupt the experience for others
• Comply with local laws and regulations during the experience

Intellectual Property

All content on our website and materials provided during our services, including but not limited to text, graphics, logos, images, audio clips, and software, are the property of Xyvorant or its content suppliers and are protected by Norwegian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without explicit written permission.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as outlined in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by applicable law, Xyvorant shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

Health and Safety

Participants engage in our culinary experiences at their own risk. While we take reasonable precautions to ensure safety, we are not liable for injuries, allergic reactions, or health issues that may arise during the experience. Participants with specific health conditions, allergies, or dietary restrictions must inform us prior to the experience and are responsible for their own wellbeing.

Force Majeure

We shall not be liable for any failure to perform our obligations under these terms if such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or government regulations.

Governing Law

These terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law principles. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Stavanger, Norway.

Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms. Upon termination, your right to use the service will cease immediately. We may also cancel or modify our services at any time with reasonable notice.

Modifications to Terms

We reserve the right to modify or replace these terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of our services after any such changes constitutes acceptance of the new terms.

Severability

If any provision of these terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
